Appeals can frequently arise from our extensive trial practice in commercial and business litigation on behalf of numerous types of commercial enterprises. The cases range the full spectrum from contract disputes, regulatory matters, class action lawsuits, antitrust matters, domestic and international arbitrations, and other complex commercial litigation.
Whether the trial attorneys are from a different firm, or are part of our own firm, we work closely with the trial team when possible to develop the arguments on appeal. We can also serve as embedded appellate counsel, advising on legal issues, precedent, or other issues that could affect a judge’s ruling, before or during trial—especially if an appeal is anticipated. An appellate attorney can help preserve issues before or during trial, or, if needed, help make the proper post-trial motions to try and preserve the record.
